In , the work conditions can be given either by the parties themselves, or by the State or in a mixed way, i.e. in tripartite manner, the State intervening with the parties.

In Quebec, the work conditions are determined by the Labor regulation, the Law on the standards of work, the Law on the decrees of collective agreement and the Law on the business acquaintances, the vocational training and the management of labor in construction industry.

Thus, the determination of the work conditions by the parties themselves is carried out either on the basis of individual relation leading to a work contract within the meaning of the Civil code, or on the basis of collective bargain leading to the conclusion of an collective agreement within the meaning of the Labor regulation .

The other way, it is the unilateral determination by the State by legislative or lawful channel of minimal work conditions. One recognizes here the role of the Law on the standards of work and the regulation which results from this.

In addition, the mixed determination of the work conditions implies an intervention of the State which, in Quebec, adapts the result of a negotiation to make it applicable to third parties which did not take part in this negotiation. One finds here the Law on the decrees of collective agreement .

Lastly, a specific legislation which is distinguished from the Labor regulation and the Law on the decrees of collective agreement: the Law on the business acquaintances, the vocational training and the management of labor in construction industry . Since 1968, this law governs the business acquaintances in construction industry. She recognizes associations known as representative and associations of contractors ready to negotiate the specific work conditions to this industry, divided for purposes of negotiations, in four sectors: residential, commercial and institutional, industrial, civil engineering and roadway system.
